TERMS AND CONDITIONS
Ownership of artwork/design:
Until full payment has been made, Love Story Designs retains ownership of all original
design project or parts contained therein, whether preliminary or final. Upon full payment, the client shall obtain
ownership of the final artwork to use and distribute as they see fit. Love Story Designs retains the right to use the
completed project and any preliminary designs for the purpose of design competitions, future publications on design,
educational purposes, marketing materials, and portfolio. Where applicable the client will be given any necessary credit
for usage of the project elements.
Originality of submissions and
design:
Love Story Designs warrants and represents that, to the best of its knowledge, the work assigned hereunder is
original and has not been previously published by a third party, or that consent to use has been obtained on an unlimited
basis; that all work or portions thereof obtained through the undersigned from third parties is original or, if previously
published, that consent to use has been obtained on an unlimited basis. By signing this document, client agrees to take
full responsibility for content client provides to Love Story Designs, and clients authorization to have us reproduce
images, writing and content provided by the client and that the works are original, not under copyright, or have been
obtained on an unlimited basis by the owner and or creator.
Limitation of Liability:
Client agrees that that he/she shall not hold Love Story Designs or its agents or employees
liable for any incidental or consequential damages which arise from delays in the completion of the project due to actions
or negligence of client or Love Story Designs including, but not limited to: unusual transportation delays, unforeseen
illness, or external forces beyond the control of the Love Story Designs or the client. If such event(s) occur, it shall
entitle the Love Story Designs to extend the completion/delivery date, by the time equivalent to the period of such delay.
Proofing of final project:
Love Story Designs shall make every effort to ensure the final product is free of any
errors, before giving the final product to you, the client. It is agreed that it is the client's responsibility to ensure
that there are no design, spelling, or grammatical errors contained in the final product. It is agreed that Love Story
Designs is not responsible or held liable for any errors contained in the final product after the final product has been
committed to print or posted in view of the public.
Exclusivity:
The relationship between Love Story Designs and you as the client is not an exclusive one.
We sell our services to a range of clients, of which may be competitors in your industry.
Agreement Duration:
The terms and conditions listed in this agreement will apply for the duration of the clients
working relationship with Love Story designs, and will apply to all projects unless a change in terms of the agreement are
provided to replace or are added to this original agreement, in such case you will be notified in writing.
Payments Outstanding:
Non-established clients will be required to pay ½ of the estimated project total down
before design begins. Payment is due in full before project is released to the client. Love Story Designs reserves the
right to retain the design until payment is received in full. Further, we also reserve the right to bill you for work
already completed, even if you have cancelled the order in mid design, and (or), apply any amount paid down toward
payment for work already completed.
Right of refusal:
Love Story Designs reserves the right to refuse service to any client.
